Acceptance and scope
These terms are an agreement between you and Sell Talk Establishment, the intended operator of HarajTok. Use of the current site confirms acceptance of the provisions concerning browsing, expressions of interest, and contact. Account, listing, transaction, payment, and shipping provisions apply once those services launch and you accept them in the app.
The Privacy Policy and any category, listing, checkout, or transaction-specific rules presented to you form part of the agreement. Mandatory rights under Saudi law always prevail.
Key definitions
The Platform means harajtok.com, the HarajTok app, and related services. A User is anyone who browses, creates an account, sells, buys, or interacts. A Seller lists a product; a Buyer makes an offer, bid, or purchase. A Service Provider is a merchant or practitioner to whom Saudi e-commerce obligations apply.
Eligibility and accounts
You must be at least 18 and legally capable of entering the transaction, or use the platform with guardian approval and supervision where permitted. Provide accurate information, protect login and verification credentials, and promptly report unauthorized use.
- Do not impersonate another person, sell or transfer an account, or use multiple accounts to evade restrictions.
- We may require additional verification before selling, receiving funds, or where misuse is suspected.
HarajTok's role
HarajTok is an online marketplace that helps users discover products, communicate, and contract. Unless a listing clearly states otherwise, HarajTok does not own the item and is not the buyer or seller. The product sale contract is between seller and buyer; HarajTok provides the available platform, payment, protection, or shipping services.
HarajTok collects the order amount and holds it with a licensed payment provider. It is not transferred to the seller except as set out in "Payments, protection, and fees".
- Ranking, labels, suggested descriptions, verification badges, and ratings are not a guarantee of authenticity or a user's financial standing.
- Independent payment, shipping, or verification providers may apply their own terms.
Listings and seller duties
A seller must own or be authorized to sell the item, describe its actual condition and defects accurately, use genuine images or video, state the price and known charges, and avoid misleading omissions or intellectual-property infringement.
- The seller must package and deliver appropriately and retain evidence of ownership, condition, and delivery when needed.
- A seller conducting business regularly must obtain required registration, licences, tax status, invoices, and warranties.
- Smart-assistant suggestions do not remove the seller's responsibility for accuracy.
Prohibited products and conduct
Users must not list, request, or promote anything unlawful in Saudi Arabia or that infringes another person's rights.
- Narcotics, unlawful alcohol or tobacco products, unlicensed regulated medicines, weapons, explosives, and dangerous or unlawful surveillance tools.
- Stolen, counterfeit, fraudulent, or unlawfully sourced goods; identity, payment, government, or banking accounts and documents.
- Exploitative, pornographic, hateful, violent, defamatory, privacy-invasive, or otherwise unlawful content.
- Fake listings, sham bidding, fabricated reviews, impersonation, spam, fraud, or attempts to bypass platform protections.
Purchases, offers, and bidding
The interface will state when a purchase, offer, or bid becomes binding. Before confirmation, the buyer will see the contract summary, total price, payment and delivery method, applicable deadline, and whether seller acceptance is required.
- An offer generally remains withdrawable until accepted unless the interface states otherwise.
- Bidding must be genuine; artificial price manipulation and coordinated bidding are prohibited.
- Obvious input errors may be corrected before contract completion, subject to law and the return policy afterward.
Payments, protection, and fees
The order amount is collected from the buyer at purchase and held with a licensed payment provider. It is not transferred to the seller before the buyer confirms receipt or the confirmation window below expires.
HarajTok will never ask you to send a full card number or verification code in chat or on a call. Platform commission, VAT, shipping, and any other charge are displayed before confirmation.
- The confirmation window is twenty-four hours, starting when delivery is recorded.
- If the buyer confirms receipt before it expires, the amount is released to the seller immediately.
- If it expires with no confirmation and no return request, the amount is released to the seller automatically.
- Opening a return request or a dispute within the window suspends release until it is decided.
- Platform commission is currently five percent of the sale amount, deducted from the seller's proceeds. It may vary by category or promotion, and what appears in the order summary before confirmation is what applies.
- VAT of fifteen percent applies to the commission and shipping, and does not apply to the product price where the seller is an individual not registered for VAT.
- Shipping is currently charged to the buyer, and what appears in the order summary before confirmation is what applies.
- Business sellers remain responsible for tax registration, invoicing, and reporting where applicable.
- A transaction may be paused, cancelled, or refunded for security, compliance, fraud, or material error checks.
Shipping and delivery
The available delivery method, coverage, cost, and expected date or calculation method are shown before purchase. Sellers must package appropriately, provide accurate shipment information, and hand the item over on time.
Delivery is carried out by the carrier, and the confirmation window starts when delivery is recorded. If another delivery method is made available, its proof-of-delivery method is shown before the order.
- The recipient should inspect the shipment and document visible damage promptly.
- Both parties must cooperate with carrier investigations and provide evidence of condition and delivery.
- Risk and responsibility pass as required by the agreed method and mandatory consumer law.
Cancellation and returns
Mandatory Saudi consumer rights and the return terms shown for the transaction apply. Eligibility may depend on the product type, seller status, item condition, disclosed defect, delivery discrepancy, and statutory exceptions.
A buyer may request a return within the confirmation window for one of the reasons below.
- Defective item, item not as described, or wrong item: return shipping is borne by the seller.
- Change of mind: return shipping is borne by the buyer, and the item must be in the condition received with all accessories and packaging.
- Where a full return is approved, the full amount is refunded including platform commission.
- A buyer should not use or alter an item beyond what is reasonably necessary to inspect it.
- Approved refunds are returned through the original method or another lawful method stated by the provider.
- Nothing in these terms reduces a non-waivable consumer right.
Seller protection
A return request is not accepted where the damage is shown to have arisen after delivery, through the buyer's act, or from use beyond inspecting the item.
- The buyer must attach evidence of the item's condition when opening the request.
- The seller must retain evidence of the item's condition and packaging before shipping.
- Photo or video documentation of condition is taken into account when deciding a dispute.
Content and intellectual property
You retain ownership of your content but grant HarajTok a non-exclusive licence needed to host, reproduce, format, moderate, display, and promote it for operating the service. You confirm that you have the rights and permissions required for every image, video, audio track, description, and mark you upload.
- Do not copy platform software, branding, or content except as permitted by law or written authorization.
- We may remove or restrict content following a credible rights complaint and may request supporting evidence.
Communication and reviews
Communication must remain professional and relevant. Abuse, threats, harassment, discriminatory content, unlawful disclosure of personal data, spam, manipulation, and attempts to move a transaction outside the platform to commit fraud or avoid protections are prohibited.
- In-app voice calls do not reveal your phone number and are recorded in full. Both parties are notified before the call and it only starts once they agree; access to a recording is limited to authorised staff checking a report or settling a dispute, as set out in the Privacy Policy.
- Neither party may record the other outside the platform, or publish any part of a call, without a lawful basis and consent.
- Reviews must reflect a genuine interaction and may not be bought, traded, or fabricated.
- Users should preserve relevant messages and evidence when reporting a dispute.
Moderation and security
We may review, restrict, label, remove, or preserve content; verify accounts; limit features; and investigate reports to protect users and comply with law. These measures do not guarantee that every misuse, counterfeit item, or fraudulent user will be detected.
- Report suspicious requests, off-platform payment demands, account compromise, or prohibited content promptly.
- Do not attempt to bypass controls, scrape protected data, introduce malware, or disrupt the service.
Availability and service changes
Features may change, be limited by category or location, or be temporarily unavailable for maintenance, security, supplier dependency, legal compliance, or events outside reasonable control. We aim to give appropriate notice of material changes where practical.
Responsibility and liability
Nothing excludes liability that cannot legally be excluded. Each user remains responsible for their content, representations, legal compliance, product, payment, delivery, and decisions. HarajTok's responsibility is assessed under Saudi law according to its actual role and proven direct loss.
- We do not guarantee that every listing is accurate, every user will complete a transaction, or every product will meet a buyer's expectations beyond applicable legal duties.
- Users should take reasonable steps to verify identity, condition, price, and safe delivery.
Suspension and termination
We may warn, restrict, suspend, or terminate an account or transaction for a breach, security threat, fraud risk, repeated complaints, unpaid amounts, or a lawful authority request. Where appropriate and permitted, we will provide notice and a way to appeal.
- Termination does not erase obligations, amounts, evidence, or provisions that by nature survive closure.
- Users may request account closure subject to legal retention and unresolved transaction requirements.
Complaints and disputes
Contact [email protected] with the account or transaction reference and relevant evidence. We will attempt a fair, amicable resolution and may ask both parties for information. This does not prevent either party from contacting a competent authority or Saudi court.
Where an amount is held, a dispute follows a faster track: if a return request or dispute is opened within the confirmation window, the amount stays held and is not released until a decision is issued.
- A dispute is opened from within the order during the confirmation window, and each party is asked to submit evidence within a stated deadline.
- A decision is issued within five business days of both parties' documents being complete. If a party does not submit what was requested within its deadline, the decision is made on what is available.
- Both parties are notified of the decision and its reasons, and it is applied to the held amount — released to the seller, or refunded to the buyer in full or in part.
- Applying the decision does not prevent either party from appealing, or from contacting a competent authority or Saudi court.
- A buyer may dispute the transaction with their bank or card issuer, and these terms do not restrict that right. We recommend exhausting the on-platform dispute path first, as it is faster and can address the underlying disagreement rather than the payment alone.
- When we are notified of an issuer dispute, both parties provide us with their documents within the deadline we set, and we may rely on the order, shipping, and message records to evidence the facts to the issuer.
- We may suspend payout of proceeds relating to the disputed order until it is resolved.
- If the dispute results in a refund to the buyer after the amount was paid out to the seller, we may recover it from whichever party is shown not to be entitled to it, by set-off against amounts we owe them or by direct claim.
- Repeated or bad-faith disputes intended to obtain both the item and the money are a violation warranting account suspension and any lawful action.
- This clause does not affect mandatory consumer rights or the cardholder's relationship with their issuer.
Governing law and amendments
These terms are governed by the laws of the Kingdom of Saudi Arabia. Competent Saudi authorities and courts have jurisdiction subject to any mandatory consumer dispute route. We may amend the terms when services or laws change and will highlight material amendments and request renewed acceptance where required.
